This agreement is made between (Owner/Resident/Club Member/Guest), and Seven Oaks Community Center, Inc. is for the use of the facilities within the common areas of the Community Center.
Owner/Resident/Club Member/Guest has requested to enter the premises for the purpose of taking part in a Community Center event and/or to use the Community Center facilities, including but not limited to any equipment used by the various clubs, equipment within the exercise room, kitchen and the pool and spa.
Owner/Resident/CIub Member/Guest VOLUNTARILY assumes the full responsibility and risk of the entry into and the use of the Community Center for whatever purpose is desired by the Owner/Resident/CIub Member/Guest. Owner/Resident/CIub Member/Guest hereby releases and discharges Seven Oaks Community Center, Inc. and its officers and employees from any and all liability whatsoever, which may arise out of or in connection with Owner/Resident/Club Member/Guest’s use.
As consideration for being permitted to enter and use the Community Center, Owner/Resident/Club Member/Guest will not make a claim against, sue or attach the property of Seven Oaks Community Center, Inc. or any predecessor or successor interest and hereby releases and agrees to indemnify and hold harmless the Seven Oaks Community Center, Inc., and any of their principals, assignees, heirs, partnerships, affiliated businesses, representatives, contractors or consultants from all actions, claims, or demands that Owner/Resident/Club Member/Guest now has or may hereafter have for liability, injury or damage arising out of the use of the Community Center whether based upon tort, breach of warranty or any other legal theory,
I have carefully read this agreement and fully understand its contents. I am aware that this is an assumption of risk, waiver and release of liability and an agreement of indemnification and further agree that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.
